TERMS AND CONDITIONS

 



1. POINT OF ORDER:-
(a) It is the responsibility of the customer to check all invoice details are correct and duly sign acceptance of the details as agreed with the salesperson.
(b) It is important to appreciate and understand that your order is a firm and legally binding contract regardless of any deposit(s) paid.
(c) Deposits are required on all orders unless agreed by the management or unless the order is part of a no deposit credit agreement already agreed by the finance company.
(d) A minimum deposit of 20% is required on all special orders.

(e) All our prices include V.A.T. unless specifically stated for some special reason. The V.A.T. charged will be the prevailing rate. Adjustments may have to be made should there be any legally imposed changes due to rate.

2. BALANCES:-
(a) Until such time as the seller has received payment in full of all sums owed to it, the legal and beneficial title to the goods shall remain with the seller.
(b) The total balance due must be paid either when the goods are ordered, collected or delivered.
(c) No goods can be left at a customer’s address unless they are paid for in full.
(d) Balances can be settled by cash, Building Society Cheque, Bank Draft, credit or debit card. Balances settled by credit or debit card must be made prior to the date of delivery or over the telephone whilst the driver is present. The only exception to this rule is when goods have been ordered on finance.
(e) All goods stored at the customer’s request must be paid for in full & will incur a weekly storage fee after 1 month
(f) Private cheques are not accepted as a means of payment on delivery or collection

(g) When payment is not made in accordance with our company policy (non payment includes cancelled or returned bank cheques) interest will be added at a rate in line with the current bank rate. This surcharge will commence from the end of the month in which the amount became due. Expenses incurred by cancelled or stopped cheques will be charged to the customer

3. SPECIAL ORDERS:-
(a) Customer special orders can only be altered or amended by agreement with the management and our supplier. Once agreed, the customer must confirm any alteration or amendment, in writing within seven days.
(b) It is the sole responsibility of the customer to check all dimensions, access and suitability of goods before ordering, as goods are made to the customer’s specification and cannot be cancelled or exchanged.
(c) Fabric & material samples are provided purely as a guide and may differ slightly from actual materials used on customers’ orders.
(d) Any fabric used for colour matching is the responsibility of the customer. We are unable to accept any liability for changes in manufacture or for failure to supply.

(e) Velvet pile cloths can suffer from creasing, crushing and flattening when pressure is applied in use. This is an inherent characteristic of the material and can vary greatly from one example to another. This does not affect the wearing properties of the material and cannot be deemed a fault. This applies to carpets and upholstery fabric. Carpets, especially plain carpet can also suffer from permanent pile reversal sometimes known as watermarking. The cause of this rare “complaint” is not fully understood. In most cases manufacturers will replace or compensate without accepting liability. The cost and quality of the product does not have any bearing on these problems.
(f) Leather as a natural characteristic may stretch & crease with use.

(g) All solid wood furniture has its own characteristic so its appearance will differ from piece to piece.

(h) Prices given are those agreed at the time of ordering and shall not be varied Special offer prices can only apply if a deposit is placed on the order while the offer is still current.

4. DELIVERY INFORMATION:-

8. CUSTOMER SERVICE DEPARTMENT:-
Our Customer Service Department handles all customer service enquiries. All service requests should be reported directly to the store where the purchase was made. Any fault on delivery should be reported to the store manager. On any fault reported after delivery, the company reserves the right to inspect and discuss with the manufacturer before any comment or agreement is made.


9. WARRANTY & REPAIRS:-

If goods prove to be faulty due to materials or workmanship within 12 months of receipt this will be corrected free of charge. Should a problem arise at a later date a charge may be made to rectify. Where any complaint is deemed by the supplier to be of shared responsibility then the customer will share any cost of repair. Warranty does not cover normal wearing or faults due to mis-use.
We operate a competitive repairs service, details of which are available on request. Before any repair work is undertaken the cost thereof will be ascertained and agreed with the customer.

10. CANCELLATIONS:-
(a) Cancellation of goods in stock can only be made by agreement with the Company and will result in the forfeiture of the customer’s deposit. The Company also reserves the right to charge a re-stocking fee. (Minimum charge of 20 % of total order value)
(b) Cancellation of Special Orders not in stock can only be made by agreement with the Company and the manufacturer. All such orders will be subject to a cancellation fee to cover administration costs incurred. (Minimum charge of 20 % of total order value)
(c) Cancellation made without agreement with the Company will result in the forfeiture of the deposit as compensation for any losses incurred by the Company. The Company reserves the right to recover a minimum of 20 % of the total order value.

(d) When cancellation is accepted due to a breach of contract by the company the deposit will be refunded.

(e) All items are treated as individual pieces, should there be a reason for a refund it would be on the individual item and not the full invoice.

11. STATUTORY RIGHTS
The statutory rights of the customer are not affected by these Conditions of Sale

 

12. DISCLAIMER

(a) We are providing this website on an "as is" basis and makes no representations or warranties of any kind, whether express or implied, in relation to this Website, or its contents and disclaims all such representations and warranties.
(b) We have taken every care in the preparation of the content with all products fairly described and measurements given to the best of our ability from our manufacturers. The appearance and colours of products are only for representation and may look different as viewing from different monitors effect the colour reproduction.

(c) The information contained in this website may contain technical inaccuracies or typographical errors. All liability howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.
(d) We will not be liable for loss or damage arising out of or in connection with the use of this Website.
(e) This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.
(f) Images used on this website are intended to portray the "types" of products we offer in our store, and are not intended to be specific items offered for sale.
The exception to this are the items on the "New Products" and "Special Offers" pages, and then these items will be subject to availability and will be subject to the other terms of this website.

(g) We make every effort to ensure that the website is free from viruses or defects, however due to the nature of the internet we will not guarantee that the use of this website shall have an effect on your computer. We recommend that you purchase the correct firewall and anti-virus software to use this site. We will not be liable for any computer equipment damage while using this website.
(h) We accept no liability for any information or content contained in external third party websites which link to or from this Website.
None of these exclusions are intended to limit any rights you may have as a consumer under local or other statutory rights.
